The operators of sexygirlspics.com are not the primary “producers” of any sexually explicit visual depictions, whether of actual or simulated sexual activity, available on the site. In this regard, the operators of sexygirlspics.com limit their commitments to the transmission, storage, retrieval, hosting and/or formatting of content, whether depictions of explicit or simulated sexual activity, provided by third party users of the website. All user-contributed content displayed on sexygirlspics.com is the result of the actions of third-party users who have control of the areas of the site that contain the content. Operators are therefore exempt from complying with Section 2257 record keeping and labeling obligations as specified in 28 CFR §75.1(c)(4). Any content found to be unlawful, obscene, harmful, offensive, defamatory, or in any way inconsistent with the site's terms of use and policies may be removed at the sole discretion of the operator or owner, pursuant to 18 USC § 2257(h)(2) (B)(v) and 47 USC § 230(c).
Any visual representations that may appear on the site, for which the site operator may be deemed the “producer,” are not subject to the stipulations of 18 USC § 2257 and 28 CFR Part 75 for one or more of the following reasons: (1) the images or videos do not depict any sexually explicit activity as defined in 18 USC § 2256(2)(A); (2) the images or videos do not show representations of the genitals or pubic area after July 27, 2006; (3) the images or videos do not display simulated sexually explicit activity; or (4) the images or videos were created before July 3, 1995.
